JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-03-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Sahebpur Kamal P.S. Case No. 328 of 2018 registered under Sections 447, 386, 504, 506 of the Indian Penal Code and under Section 25(1-b)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that as per allegations one Gautam Rai came to the house of the informant and started abusing, they took out pistol and fired at the house of the informant and further when people assembled Gautam Rai threw his pistol towards this petitioner who fled away with the pistol.

No.13226 of 2019(2) dt.07-03-2019 2/3 Learned counsel for the petitioner submits that there is no allegation of firing against this petitioner, he has been falsely implicated in the present case because of land dispute over a passage in the village. It is submitted that because of the village politics only he has been made accused in the present case and a fake story has been created.

Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case whereunder there is no allegation of firing against this petitioner and there is said to be a land dispute over which the villagers are fighting, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - V, Begusarai, in connection with Sahebpur Kamal P.S. Case No. 328 of 2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks
