JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioners and the learned APP for the State through video conferencing. The petitioners seek bail in connection with Special Case No.8197 of 2021 (Excise) arising out of Ramkrishna Nagar P. S. Case No.607 of 2021, instituted for the offences under Sections 30(a), 32(ii), (iii) and 41of the Excise Act, 2018. Learned counsel for the petitioners submits that the petitioners are in custody since 07.12.2021, charge-sheet has been submitted in the case and petitioner no.1 has antecedent of one case and petitioner no.2 is a person with clean antecedent. Allegation is of recovery of 342 litre of liquor from a

The learned counsel for the petitioners submits that petitioner no.1 is the driver and as such was not knowing what the owner had kept in the car and petitioner no.2 had taken lift and as such, he was also not aware what was loaded in the car. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted in the case and petitioner no.2 is a person with clean antecedent, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 4,000/- (Rupees Four Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Special Case No.8197 of 2021 (Excise) arising out of Ramkrishna Nagar P. S. Case No.607 of 2021. The application stands allowed.
