The petitioner seeks regular bail in connection with Hathua P.S. Case No. 160 of 2018 registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The case of the prosecution is that the informant along with his younger brother and cousin brother were coming from Hathua Block towards Mirganj on motorcycle when on the way the accused persons namely Veer Singh @ Vishal Singh, Karan Singh and Arun Singh had stopped the brother of the informant and fired gun shots resulting in death of the younger brother of the informant at the hospital.

The learned counsel for the petitioner submits that

No.9263 of 2019(2) dt.18-02-2019 2/2 the petitioner was admittedly neither present at the place of occurrence nor has been alleged to have fired gun shot resulting in death of the younger brother of the informant, however, only allegation against the petitioner is that some time back he had threatened the informant with dire consequence on account of certain election dispute. It is further stated that the petitioner is an accused in one other case in which he is already on bail. The petitioner is stated to be languishing in custody since 20.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Hathua P.S. Case No. 160 of 2018.
