JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Neemachandpura P.S. Case No. 08 of 2015 registered under Sections 147, 148, 149, 341, 323, 342, 363, 364, 302, 201, 120B of the I.P.C. and 3⁄4 of S.C./S.T. (prevention of atrocities) Act. On the basis of the complaint petition of the informant, Rekha Devi, the present case has been lodged alleging therein that her son, Lalan Paswan aged about 15-16 years was taken for working by this petitioner and six others named in the complaint petition, but son of the informant did not return. Thereafter, when she made enquiry about her son, the accused persons assaulted and abused her by denoting her caste name.

No.55322 of 2015 (3) dt.11-01-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that in fact, son of the informant is mentally weak and has been missed somewhere and due to dirty politics in the village, he has been implicated in the present case along with others with false allegation. It is also submitted that petitioner has no criminal antecedent and is in custody since 20.05.2015. It is further submitted that similarly situated co-accused Manoj Chaurasiya has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 49905 of 2015 on 11.12.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Begusarai in connection with Neemachandpura P.S. Case No. 08 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
