JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Baniapur P.S. Case No. 279 of 2016, registered under Sections 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that five persons named in the F.I.R., including the petitioner, reached near the informant and one Guddu Singh shot fire at his stomach, when informant tried to flee away then this petitioner is said to caught holds him and Vishal Singh shot fire at his waist.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case showing the overt act of catching hold the informant at the time of causing

Patna High Court Cr.Misc. No.3202 of 2017 (2) dt.08-02-2017 2/2 fire arm injury by co-accused. Further submission is that there is specific allegation against co-accused Guddu Singh and Vishal Singh, who shot fire at the informant. Further submission is that petitioner has no criminal antecedent is in custody since 05.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-XI, Saran in connection with Baniapur P.S. Case No. 279 of 2016.
