The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 30(a) and 37(b) and (c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 19.515 litres of IMFL was recovered from the tempo wherein the petitioner was one of the occupants.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 22.4.2022 (Annexure-1) passed in Cr. Misc. no. 13922 of 2022 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 27.2.2022 ie 1 year 1 month.

Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order of rejection dated 22.4.2022 together with the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with G.R. Case no. 94/2022, Tr. Case no. 3178/2022 (arising out of Jamhor P.S. Case no. 19 of 2022) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IX - cum - Special Court, Excise, II, Aurangabad.
