Victim has been recovered and her statement has been recorded under section 164 of the Cr.P.C in which she stated that she was taken away by the petitioner and while she along with the petitioner was sitting at Mugalsarai railway station, they were caught by a lady constable and after that handed over to Dhanarua police station.
The victim has, nowhere, stated that the petitioner forced her for marriage or seduced to illicit relation. Moreover, victim has been found between 17 to 19 years in medical examination.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
Patna High Court Cr.Misc. No.57011 of 2015 (2) dt.18-12-2015 amount each to the satisfaction of Sri Hare Ram, Judicial Magistrate, Ist Class, Masaurhi/ concerned court in Dhanarua P.S. Case no. 194/2015.
