The petitioners are apprehending their arrest in connection with Lalganj P.S. Case No. 303 of 2015 for the offences instituted under Sections 323, 364, 341, 342, 427, 379 and 384/34 of the IPC.

The prosecution case, in brief, is that the informant runs a wine shop. It is alleged that on 17.10.2015 petitioner nos. 1 and 2 came at the shop and demanded wine from the staff. The accused persons paid only Rs.100/-. When he demanded rest money, the accused persons abused and damaged the shop with Lathi and Danda. They also assaulted the informant and got seated

Patna High Court Cr.Misc. No.5572 of 2016 (2) dt.28-03-2016 2/2 in the car and the associates of Sandeep Sahani also damaged the vehicle by Lathi, Danda and stones. They also snatched the gold chain and took away cash Rs. 35,000/- from the informant. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners have falsely been implicated in the present case. From perusal of Annexure-2, it is evident that the matter has been settled between the parties.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Lalganj P.S. Case No. 303/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
