However, the aforesaid act of the petitioners be ignored due to present situation of Pandemic of COVID-19.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor appearing for the State. Petitioners apprehend their arrest in connection with Allouli P.S. Case No. 297/2014 registered for offences punishable under Sections 147, 148, 379 of the Indian Penal
Patna High Court CR. MISC. No.20948 of 2020(2) dt.06-11-2020 2/2 Code read with Section 27 of Arms Act.
Originally, informant filed complaint case which was converted into above stated police case. Moreover, at para 6 of the petition it has been pleaded that prior to institution of the present case, the complaint case bearing Complaint Case No. 970C/2013 was filed against the prosecution party and in retaliation to the aforesaid complaint case, the present case was lodged. It is also submitted that there is land dispute between the parties and on account of the aforesaid land dispute, the informant has brought this false case. Moreover, petitioners do not have any criminal antecedent.
Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in connection with Allouli P.S. Case No. 297/2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
