====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections-385/387 of the Indian Penal Code. It has been submitted that the petitioner is not named in the FIR. The co-accused was arrested by the police whose confessional statement was recorded, in which, he named this petitioner.
As per written report, the informant is in-charge Headmaster of Middle School who received a call for demand of ransom money of Rs. 10,000,00/- The informant expressed his inability to fulfill the same as a result whereof, he was threatened to face dire consequences. The learned Additional Sessions Judge has mentioned in the impugned order that at paragraph-24 of the
Patna High Court Cr.Misc. No.4453 of 2017 (2) dt.13-02-2017 2/2 case diary, the petitioner made his confessional statement. Considering the above-said facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sonbarsa P.S. Case No. 61 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi subject to condition that both the bailors will be close relatives of the petitioner.
