====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-02-2019 Heard Sri Manish Kumar No. 2, learned counsel for the petitioner and Sri Madan Kumar, learned Additional Public Prosecutor.

This is second attempt for grant of bail on behalf of petitioner. On 07.05.2018 vide Cr. Misc. No. 27345 of 2018 prayer for bail of the petitioner was rejected. Sri Manish Kumar No. 2, learned counsel for petitioner submits that petitioner has falsely been implicated in the present case. Besides this, it has been argued that in the present case number of accused persons have been granted bail. Some of the accused even after rejection of prayer for bail of this petitioner was granted bail by Co-ordinate Bench of this court. On aforesaid grounds a prayer has been made for granting

Patna High Court Cr.Misc. No.9348 of 2019(2) dt.20-02-2019 2/2 bail.

The petitioner is in custody since 29.12.2017 in connection with Sherghati ( Dobhi ) P.S. Case No. 421 of 2013 registered for the offence under Section 147, 148, 149, 302, 307, 326, 332, 333, 353, 121(A), 124(A), 427 and 120 (B) of the Indian Penal Code, 1860, Section 27 of the Arms Act , 1959, Section 17 of the Criminal Law Amendment Act and Section 10, 16, 13, 20, 21, 38 and 39 of the Unlawful Activities ( Prevention) Act, 1967.

On last occasion it was also noticed that he remained absconder for some time. Besides this, he was having criminal antecedent. Accordingly, I do not find any ground to review my earlier order.

The prayer for bail again stands dismissed.
