JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-09-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

Prayer for bail of this petitioner was earlier rejected by this court vide order dated 09.11.2020 passed in Cr. Misc. No. 27679 of 2020. By order dated 04.08.2021 a report was called for from the trial court about the stage of trial which reveals that cognizance has already been taken on 16.08.2021 and charge is still to be framed.

Considering the facts of the case and nature of accusation, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, once charge is framed and trial

Patna High Court CR. MISC. No.20425 of 2021(4) dt.15-09-2021 2/2 commences, the petitioner, shall be released on bail by the trial court to its own satisfaction on the condition that the petitioner will co-operate in the trial.
