2. The petitioner has preferred this application for grant of regular bail in connection with Chakiya P.S. Case No. 47/2024 dated 19.08.2024 registered for the offence punishable u/s 115(2), 127(1), 109 and 352 of the B.N.S. and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and the co-accused person came to the house of the informant and started abusing. On protest, the co-accused Rajesh Singh started assaulting the informant. When the informant tried to call the nearby people, the petitioner with an intention to kill fired on the stomach of the informant due to which he fell on the ground.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case on account of land dispute. Learned counsel has submitted that the petitioner and the informant are cousin grandfather and cousin grandson. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has three antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 26.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the specific allegation of firing is against the petitioner. As per para. 7 of the case diary, the grandmother of the informant has stated that she saw her grandson injured and the petitioner and the coaccused, Rajesh Singh were openly brandishing a firearm. As per the Medical Report, single wound of gunshot was found on both side of the left chest and there is entry wound on left side of the chest and exit wound on the left back side of the chest.

Considering the aforesaid facts and circumstances of the case as well as the specific allegation of firing is against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Chakiya P.S. Case No. 47/2024, pending in the court of learned C.J.M.,

7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
