JUSTICE SANJAY PRIYA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Tarari P.S. Case No.53 of 2016 instituted for the offence under Section 302/34 of the Indian Penal Code.

It is alleged that informant found dead body of his brother Jai Mangal Sharma lying in lane of his house with one fire-arm injury on his abdomen.

The informant has merely raised suspicion against this petitioner in the written report.

The learned A.P.P. after looking into the case diary has submitted that witnesses have raised mere suspicion against this petitioner.

The petitioner is said to be in custody since

Patna High Court Cr.Misc. No.2238 of 2017 (3) dt.17-03-2017 2/2 20.10.2016.

Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Tarari P.S. Case No. 53/2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
