JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Falka (Pothia) P.S. Case No. 363 of 2018 registered for the offences punishable under Sections 366A, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that there is delay in lodging the FIR and further there was love affair between them.

Heard learned APP, who has drawn my attention towards the statement of victim girl made under Section 164 Cr.P.C. in which she has supported the prosecution case of kidnapping by the petitioner and also of committing rape upon her.

Patna High Court Cr.Misc. No.9207 of 2019(2) dt.19-02-2019 2/2 Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is rejected. Accordingly, this application is dismissed.
