There happens to be an allegation against the appellant and others that during course of immersion they, on account of lower caste forbidden the prosecution party to participate and during course thereof, Bhadai Yadav struck with butt blow over head of the informant Vijay Kumar Paswan. The appellant and others are also alleged to have assaulted. The appellant happens to be under custody since 15.10.2016.

Considering the facts and circumstances of the case, appellant Suman Yadav @ Suman Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
