Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against unknown. The petitioner is in custody since 26.11.2018. Investigation of the case is already complete. Submission is that petitioner was never put on Test Identification Parade, nor the looted motorcycle was recovered from the possession of the petitioner. Only material is suspicion based on the statement of co-accused, Hira Sahni, who has already been allowed bail by the court below. Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.9041 of 2019(3) dt.30-04-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Town (Motihari) Police Station Case No.498 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
