JUSTICE SANJAY PRIYA ORAL ORDER 2/ 04-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Gandhi Maidan P.S. Case No.285 of 2015 instituted for the offence under Section(s) 379, 411, 414/34 Indian Penal Code.

It has been submitted that the petitioner was not caught at the spot. His name has been disclosed by co-accused, Lablu Kumar Singh, who was apprehended at the spot. It is mentioned in the written report that the informant had gone to Bank to withdraw money and when he returned he did not find his motorcycle.

It is mentioned in the written report that one person, namely, Lablu Kumar Singh was apprehended, who disclosed

Co-accused, Lablu Kumar Singh, has already been granted bail by a coordinate Bench of this Court by order dated 06.10.2015 passed in Cr. Misc. No.45663 of 2015. The petitioner is said to be in custody since 14.09.2016.

In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna, in connection with Gandhi Maidan P.S. Case No.285 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
