Petitioner seeks bail in connection with Benm P.S. Case No. 63 of 2016 registered under Sections- 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no committed any such offence and he has been falsely implicated in the case. Petitioner is in custody since 14.06.2016.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused with direct allegation. During investigation, witnesses have supported the prosecution case. Post mortem report suggest that
Patna High Court Cr.Misc. No.3330 of 2017 (4) dt.20-03-2017 2/2 death was caused due to head injury.
Considering the nature of allegations levelled in the first information report coupled with the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
