2. The petitioners apprehend their arrest in a case registered for the offence under Sections 30(a) and 41(i) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 21 liters of country-made liquor, kept in a plastic bag, has been recovered from behind the house of petitioner.

4. Learned counsel for the petitioners submits that no incriminating article has been recovered from the conscious possession of these petitioners and have been implicated in this case only on suspicion. Though, petitioner no. 1 has got clean antecedent, but petitioner no. 2 has got one criminal antecedent of similar nature.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the nature of accusation and clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran, Motihari in connection with Pachpakari P.S. Case No. 20 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
