====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under section 366 of the Indian Penal Code.
3. The prosecution case in brief is that daughter of informant Juhi Kumari aged about 18 years went to Samukhiya more for withdrawing money from Gramin Bank but she did not return. During search, informant learnt that co-accused Nitish Kumar abducted her for the purpose of marriage.
4. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR and he has been implicated in this case only because he happens to be relative of co-accused Nitish Kumar. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail. He submits that the victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has stated that this petitioner offered her intoxicated cold drink and on consuming the same, she became senseless and on regaining sense, she found herself in a train with co-accused Nitish Kumar. Thereafter, petitioner threatened the victim on phone to
Patna High Court CR. MISC. No.9786 of 2025(3) dt.15-04-2025 2/2 accompany co-accused Nitish Kumar, otherwise he would kill her and family members. Co-accused Nitish Kumar took the victim to Delhi and kept in a room.
6. Considering the nature of accusation and aforesaid statement of the victim, prayer for bail of the petitioner is rejected.
