Petitioner seeks bail in connection with Piprahi P.S. Case No. 93 of 2016 registered under Sections- 30a, 33, 36, 38 of the Bihar Excise (Amendment) Act, 2016. Learned counsel for the petitioner submits that the alleged recovery has been made from the back seat of the tempo and the petitioner was only a passenger on the alleged tempo. Petitioner has no concern with the alleged recovered articles. Petitioner has no criminal antecedent and is in custody since 23.11.2016.
Considering the facts and circumstances of the case, the petitioner above named is directed to be released on
Patna High Court Cr.Misc. No.4204 of 2017 (2) dt.08-03-2017 2/2 bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in connection with Piprahi P.S. Case No. 93 of 2016.
