14-07-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Isuapur P.S. Case No. 93 of 2020, registered for the offence under section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, on 31.05.2020, while the informant was going to Isuapur market, then on the way, petitioner alongwith two co-accused, armed with lathi, danda and iron rod, came and demanded Rs. 10,000/- from the informant and also threatened him. It is further alleged that thereafter, the accused persons assaulted with iron rod on the head of informant and damaged his motorcycle and snatched some important paper & money from informant's pocket.

No.20403 of 2021(2) dt.14-07-2021 2/3 It is submitted on behalf of petitioner that petitioner and informant are co-villager and due to village politics, petitioner has been falsely implicated in this case. It is further submitted that the present case is in retaliation of a case, which was filed by the the mother of petitioner against informant side, vide Isuapur P.S. Case No. 94 of 2020. There is no specific allegation of assault against this petitioner. Petitioner has got clean antecedent and he is in custody since 31.05.2020. Learned A.P.P. for the State has opposed the bail petition.
Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 7th, Saran, Chapra in connection with Isuapur P.S. Case No. 93 of 2020, on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the
