This application is for grant of bail in connection with Phulparas P.S.case No.142 of 2016 for the offence under Sections 457, 380 & 411 of the Indian Penal Code.
It is submitted on behalf of the petitioner that he has remained in custody for about nine months, however, it is submitted that the materials available in the F.I.R. as well as the case diary shows that one Jitan Mandal was arrested and recovery is from Jitan Mandal but the petitioner has been made accused in this case and in a large number of cases, he is accused but in most of the cases either he has been released or acquitted. Heard learned A.P.P. also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.2901 of 2017 (2) dt.13-02-2017 2/2 Having heard both sides. From perusal of the record, it appears that the petitioner has clean antecedent and he is accused in 13 other cases but in the present case, he has changed his name as appears from the impugned order, as such at present, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
