The petitioner seeks bail in a case instituted for the offence under Section 414 of Indian Penal Code and Sections 25(1-b)A/26(ii) and 35 of Arms Act.

It has been submitted that the name of this petitioner has been disclosed by co-accused Bhutto Mallik and Hari Lal Yadav, who were apprehended by the police on the spot and a firearm is alleged to be recovered from their possession. Those two accused disclosed the name of this petitioner. From the written report itself, it appears that no any incriminating articles have been recovered from possession of this petitioner. The seizure list, which is also available with the written report shows

Patna High Court Cr.Misc. No.2267 of 2017 (2) dt.04-02-2017 2/2 that firearm has been recovered from Bhutto Mallik and Hari Lal Yadav. Petitioner is said to be in custody since 02.08.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 348 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
