Petitioner apprehends arrest in a case registered for the offence punishable under sections 272, 273 of the I.P.C and Section 30 (a) of the Bihar Prohibition and Excise Act. Prosecution case is that 240 liters raw spirit was recovered from Bolero.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner name was transpired only on the basis of suspicion.

Learned counsel for the State submits that the huge quantity of liquor recovered from the conscious possession of

Considering the fact that the petitioner has got two criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
