The petitioner seeks bail in connection with Sarmera P.S. Case No.116 of 2016 registered under Sections 147, 149, 152, 341, 323, 332, 333, 337, 353, 307, 427 and 504 of the Indian Penal Code.
The accusation is that on receiving information about scuffling in between the coaching students and bus staffs about 200 meters away to Sarmera Police Station, the police reached there and took one injured, namely, Indrajeet Kumar, and requisition was issued for his treatment. In the meantime, 28 persons, named in the F.I.R., and 150 unknown persons entered in
Patna High Court Cr.Misc. No.2311 of 2017 (2) dt.31-01-2017 2/2 the campus of the Police Station and started to abuse and brickbatting in which the informant being the Officer-in-Charge of Sarmera Police Station and other police officials sustained injuries. Due to that reason, the police also used slight force. At that time, five persons including the petitioner were apprehended by the police.
Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act is attributed to the petitioner. The petitioner having no criminal antecedent is in custody since 02.12.2016. Moreover, the injuries, which are said to be sustained by the informant and other police officials, are simple in nature. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Sarmera P.S. Case No.116 of 2016.
