Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/354B/379 and other ancillary sections of the Indian Penal Code.
As per the prosecution case, all the FIR named accused persons including these petitiners went to the house of the informant and assaulted her and tore her clothes. They took
Patna High Court CR. MISC. No.9994 of 2023(2) dt.25-04-2023 2/2 away cash Rs.1 lac, clothes and ornaments.
Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Specific allegation of assault is against other accused persons and no overt act has been alleged against the petitioners. Doctor has found the injuries to be simple in nature.
Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in Ramgarhwa Police Station Case No. 02/2019/Tr no. 1818 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
