====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 14-02-2025 Heard Mr. Jay Ram Prasad, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned APP for the State.

2. The petitioner seeks regular bail in connection with Nadi P.S. Case No. 107 of 2019 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act as amended up-to-date.

3. Learned counsel appearing on behalf of the petitioner submitted that earlier the petitioner was granted prearrest bail by this Court vide order dated 11.08.2023 passed in Cr. Misc. No. 47309 of 2023, but his bail bond was not accepted due to incorrect criminal antecedent mentioned in paragraph no.3 thereof. Learned counsel further submitted that petitioner

4. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

5. In the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City, in connection Nadi P.S. Case No. 107 of 2019, subject to the following conditions:

(i) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court. (iii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (iv) If the petitioner is found involved in similar nature of offence, after his release on bail, the trial Court shall

(v) The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application.
