2. The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 260 of 2021, registered for the offences punishable under Sections 447, 341, 323, 307 of the Indian Penal Code.

3. As per allegation, co-accused Jai Shankar Prasad forcibly started constructing a boundary wall on the land of the informant. On protest, he assaulted the informant on his head with iron rod. Further, co-accused Rambha Devi and the petitioner assaulted him with lathi, danda, bamboo and iron rod.

4. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and has falsely been implicated in this case. The allegation of inflicting assault is

Patna High Court CR. MISC. No.13701 of 2024(2) dt.12-03-2024 2/2 on co-accused Jai Shankar Prasad and not against the petitioner. The allegation against the petitioner is general and omnibus.

5. Considering the above-mentioned facts and circumstances especially the clean antecedent, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhepura in connection with Madhepura P.S. Case No. 260 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
