The petitioner seeks bail in connection with registered under Section 376, 307/34 of the IPC.

The accusation against the petitioner is that he developed illicit relationship with the informant, Priyanka Kumari, aged about 20 years, on the pretext of performing marriage but later on the petitioner refused. In the meantime, family members of the informant came to know about this fact and they ousted the informant from their house. Thereafter, she went to the Ice Cream factory, where the petitioner used to work, and asked him to perform marriage. The petitioner took her on motor cycle on the pretext of performing marriage in Civil Court but in the way he

Patna High Court Cr.Misc. No.55476 of 2015 (2) dt.11-01-2016 2/2 speeded up the motor cycle on which she fell down on the road and after regaining consciousness she found herself in a hospital at Sitamarhi under treatment.

Learned counsel appearing on behalf of the petitioner submits that the informant is aged about 20 years according to her written statement and she performed marriage with one Satendra Rai of village Pirokhar, PS Madhwapur, district Madhubani about four years ago. She also filed complaint case No. C-236 of 2014 against her husband Satendra Rai under section 498A and other sections of the IPC which is pending in the court of learned SDJM, Pupari and the present case has been filed only to harass the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathanaha P.S. case No. 117 of 2015.
