The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the FIR, about 11 litres of liquor and 31 litres of cough syrup besides some vehicles were recovered from the Khadi Bhandar building. Allegation is that the accused were dealing in liquor.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his person or possession. He was not arrested at the spot. He has no concern with the Khadi Bhandar building as he was posted as night-guard in Gogari Jamalpur Nagar Panchayat. The petitioner is in custody since 5.1.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Gogari P.S. Case no. 449 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Khagaria.
