The State of Bihar .... .... Opposite Party ====================================================== Appearance :

For the Petitioner : Mr. Manish Kumar, Advocate For the State : Mr. J.K. Singh, A.P.P. ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 13-04-2016 Heard the learned counsel for the petitioner and learned APP for the State.

2. Petitioner has renewed his prayer for bail for the offences under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act in connection with Bakhtiyarpur P.S. Case No.226 of 2013 having twice earlier rejected by orders dated 03.03.2015 and 04.11.2015 in Cr. Misc. Nos.43149 of 2014 and 41888 of 2015.

3. Learned counsel for the petitioner submits that the petitioner has been implicated merely because he happens to be the owner of the truck from which the offending goods had been recovered, but however, the truck had been given on hire and as such he has no connection with the goods in question.

Patna High Court Cr.Misc. No.56277 of 2015 (2) dt.13-04-2016 2/2

4. One Suresh Choudhary, who was apprehended at the place of occurrence, had stated that the two quintals of Ganja on the truck belongs to Amit Kumar and his Bahnoi Rajesh Singh. The said Rajesh Singh has since been granted bail by this Court.

5. It is not in dispute that the truck in question belongs to the petitioner. It has also been stated that the trial is progressing as five prosecution witnesses have already been examined.

6. Having heard learned counsel for the parties, this Court does not find any reason to take a different view in the matter and hence the bail petition stands dismissed. (Vikash Jain, J) N.H./- U T
