JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the sister of the informant is languishing in custody since 24.9.2015 in a case registered for the offences punishable under Sections 342,323,307,498A and 504/34 of the Indian Penal Code. The basic accusation is of torture and making attempt to throttle the informant by putting rope around her neck. It is submitted by the learned counsel for the petitioner that one abrasion simple in nature has been found on the neck of the informant. The accusation is omnibus in nature. More over, the investigation has already concluded and above all, the petitioner is ready to keep the sister of the informant as wife with full dignity and honour. Statement to that effect has been made in paragraph
Patna High Court Cr.Misc. No.58005 of 2015 (2) dt.04-01-2016 2/2 10 of the petition which reads as follows:
"That the petitioner is ready to keep his wife withal dignity and honour."
Learned counsel for the informant submits that there is specific accusation of throttling against the petitioner. Considering the nature of accusation and the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No. 510 of 2015.
