1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 406 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the complainant alleges that he is a truck driver and wanted to purchase a second hand truck, hence on 20.06.2019, met the co-accused persons who came to him and offered to get finance a second hand truck from Sri Ram Finance and took
2/4 the complainant to the petitioner who disclosed that the second hand truck is of Shiv Nath Mahto and on the said pretext kept his Aadhar card, Passbook and photo. Further, an amount of Rs.13,10,000/- was sanctioned in the name of the complainant, out of which an amount of Rs.11,50,000/- was transferred in his account, but on 01.07.2019, the accused persons got an amount of Rs.6,00,058/- transferred in the account of Shiv Nath Mahto. It is next submitted that the vehicle was not delivered.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the complainant. It is next submitted that petitioner is Branch Manager of Sri Ram Finance Company. It is further submitted that complainant approached the petitioner for getting loan sanctioned for purchasing a second hand truck. Accordingly, the loan was sanctioned and the amount was credited in the account of the complainant. It is next submitted that petitioner has no concern with Shiv Nath Mahto. It is also submitted that an amount of Rs.6,00,058/- was transferred in the account of Shiv Nath Mahto from whom the complainant intended to purchase a second hand
3/4 truck. It is further submitted that it does not appear probable that without signature of the complainant, the money would have been transferred in the account of Shiv Nath Mahto. It is next submitted that since the company is trying to recover the loan amount from the complainant, as such, in order to coerce the petitioner into submission, the instant false case came to be instituted. It is also submitted that had an FIR been instituted, perhaps the police would have investigated the case in its correct perspective, but then, the complainant very wisely instituted a complaint case knowing that cognizance would be taken based on material furnished by the complainant and his two witnesses.
5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, abovenamed, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
4/4 learned Trial Court where the case is pending/successor Court in connection with Complaint Case No.341 of 2022, subject to the conditions laid down under Section 482(2) of the B.N.S.
