1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Mirganj P.S. Case No. 468 of 2023 dated 11.12.2023 registered under Sections 420, 467, 468, 471, 120B/34 of the I.P.C.
3. The prosecution case as per the F.I.R. is that the petitioner during second phase of teachers employment of Gram Panchayat Raj Sigha, Block- Hathua submitted the application along with forged certificates.
4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and her appointment has been cancelled on the basis of inquiry and the report of the inquiry committee that the petitioner obtained employment on the basis of forged documents. Patna High Court CR. MISC. No.12258 of 2025(2) dt.21-02-2025 2/2 no. 47, which is part of the F.I.R. Similarly situated co-accused / Kumari Prerna Tiwari @ Prerna Tiwari @ Smt. Kumari Prerna Tiwari has been granted anticipatory bail by this Court vide order dated 07.08.2024 passed in Cr. Misc. No. 46374 of 2024.
5. Regard being had to the submission made by the parties, taking into consideration the fact that petitioner has been terminated from service and similarly situated co-accused person has been granted anticipatory bail, as such, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Mirganj P.S. Case No. 468 of 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
