ANJANA PRAKASH ORAL ORDER 02-03-2016 It appears from the report of the S.P. that witnesses are not interested in deposing before the court. Be that as it may, on the undertaking of the petitioner that he shall physically appear on each and every date of the trial, let the petitioner above named, be released on furnishing bond of Rs.5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist, Barh, District- Patna in connection with S. Tr. No.820 of 2010 arising out of Bakhatiyarpur P.S. Case No.72 of 2009, subject to the conditions (i) That one of the bailor will be brother-in-law of the petitioner and the others with be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will undertake to furnish
Patna High Court Cr.Misc. No.33307 of 2014 (10) dt.02-03-2016 2/2 information to the Court about any change in address of the petitioner, (iv) That the petitioner will give an undertaking that he will receive the police papers on the given date and be present on date fixed for charge and if he fails to do so on two given dates and delays the trial in any manner, his bond will be liable to be cancelled for reasons of misuse, (v) That the petitioner will be physically present on each date during trial and if he fails to do so on two consecutive dates without any reasonable cause, his bond shall stand automatically cancelled.
