JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-10-2022 Though the present writ petition has been filed by the petitioner for grant of family pension, however, a counter affidavit has been filed on behalf of the respondents no. 2 to 4, wherein it has been stated that the Food Corporation of India does not have any scheme to pay pension/ family pension, inasmuch as there is no enactment existing in the respondentCorporation which permits the same, nonetheless, certain deductions are made from the salary of the concerned employees and the same are deposited with the Central Provident Fund Organization, from where, pension/ family pension is paid. It is also submitted that the petitioner was getting family

Patna High Court CWJC No.2996 of 2022(3) dt.11-10-2022 2/2 pension up to the year 2010, however, as she did not submit her life certificate, the family pension was discontinued. In such view of the matter, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Central Provident Fund Organization/ the concerned Bank for redressal of her grievance regarding non-payment of family pension. Liberty so sought, is granted.

The writ petition stands disposed off.
