In this case, the petitioner is seeking regular bail in connection with Brahampura P.S. Case No.178 of 2014, registered for the offences punishable under Section 364(A)/34 of the Indian Penal Code.

In the present case, allegation has been made against the petitioner that when the victim was going to catch the train at railway station, four persons came in a three wheeler and offered a ride to the railway station but instead of carrying the victim to the railway station, they have kidnapped and kept him under threat and assaulted him badly and demanded a ransom of Rs.1,00,000/-. Learned counsel for the petitioner submits that the present petitioner is the owner of the vehicle.

No.57032 of 2015 (3) dt.09-02-2016 2/2 Having considered the facts and circumstances of the case, let the petitioner-Govind Kumar be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Brahampura P.S. Case No.178 of 2014, subject to the conditions that:- (i) one of the bailors will be a close relative of the petitioner;

(ii) If the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to make prayer for cancellation of his bail and the Court below will pass necessary order, including cancellation of bail and;

(iii) that the petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel the bail bonds of the petitioner.
