The instant writ application has been filed for the following reliefs:- (i) For directing the respondent authorities particularly respondent no.4 to initiate encroachment proceedings under Bihar Public Land Encroachment Act, 1956 vide issuing notice u/s 6(1) of the said act, for removing encroachment from the public land pertaining to Plot No.77, Khata No.99, Thana No.340, Area-22 decimal, Plot No.70, Khata No.92 and Plot No.748, Khata NO.115, Area-67 decimal situated at MauzaThakuri, Patna. The said land has been encroached upon by the private respondent no.6 by constructing illegal structure and

(ii) For directing the respondent no.4 to give effect to the order passed by Respondent No.4 issued vide Memo No.2327 dated 12.10.2024 (Annexure-P/2) and get the aforesaid land evicted from the unlawful possession of private respondents from the land in question.

(iii) For any other relief(s) to which the petitioner is entitled in the facts and circumstances of the case.

The petitioner is directed to file a fresh representation within a period of three weeks from today with regard to the encroachment, in question, giving full details of the persons who have made construction over the land and creating obstruction over the public road by blocking the same. The petitioner is also permitted to give details of all such properties which, according to him, is a public land and is under encroachment by the encroachers and on finding the statement to be true in reference to the revenue record, appropriate action shall be taken by issuing notices to the concerned encroachers.

4. It is expected that once such an application for removal of the encroachment is filed by the petitioner, then the Circle Officer, Paliganj, District- Patna will initiate the appropriate proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956 and, after giving notice to all

Patna High Court CWJC No.3120 of 2025(2) dt.24-07-2026 3/3 concerned, necessary orders shall be passed, adjudicating the issues, in question, and once it is found that the land, in question, is a public land and the same has been encroached by the private persons, the same shall be made encroachment free within the period of one month from the date of passing of the final order in the proposed encroachment case.

5. It is expected that the entire exercise shall be carried out and concluded within the time frame of six months from the date of initiation of proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956.

6. With the aforesaid observation and direction, the writ petition stands disposed of.
