07-02-2017 Heard Sri Jitendra Prasad Singh, learned counsel for the petitioner and Sri Binod Kumar, learned counsel for opposite party/husband of the petitioner.
The petitioner has approached this Court under Section 24 of the Code of Civil Procedure, 1908, with a prayer to direct for transferring the Matrimonial Case No. 32 of 2014 from the court of Principal Judge, Family Court, Khagaria to the court of Principal Judge, Family Court, Purnea.
At the very outset, Sri Binod Kumar, learned counsel for the opposite party submits that prior to filing of this case, earlier two cases were filed by the petitioner and those cases are continuing at Purnea and as such, the husband/opposite party is
Patna High Court MJC No.3683 of 2014 (4) dt.07-02-2017 2/2 not opposing for transfer of the case.
Accordingly, with the consent of the parties, it is directed to transfer the Matrimonial Case No. 32 of 2014 from the court of Principal Judge, Family Court, Khagaria to the court of Principal Judge, Family Court, Purnea with further direction that petitioner shall render full cooperation for early disposal of the matrimonial case i.e. Matrimonial Case No. 32 of 2014. The record of the said case must be transferred to Purnea within a period of four weeks from the date of receipt/production of a copy of this order. After receipt of the record, the learned Principal Judge, Family Court, Purnea shall take all steps for early disposal of the case. The petition stands disposed of.
