Petitioner seeks bail in connection with Mahuawa (Chhauradano) P.S. Case No. 77 of 2016 registered for the offences punishable under Sections-272, 273/34 of the Indian Penal Code and Sections-47(a)/53(b) of the Bihar Excise (Amendment) Act, 2016.

Allegedly, the petitioner and co-accused Khilauna Singh were apprehended when they were coming on a motorcycle with black colour bag containing 120 bottles each containing 300 ml. Nepali Soffee (liquor).

Submission is of false implication and that nothing

Patna High Court Cr.Misc. No.3493 of 2017 (2) dt.27-02-2017 2/2 has been recovered from conscious possession of the petitioner. The petitioner is in custody since 22-07-2016 and by remaining in custody, he has been sufficiently penalized.

The learned APP fairly submits that the petitioner has sufficiently remained in custody.

In the facts and circumstances stated above, the petitioner named above, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahuawa (Chhauradano) P.S. Case No. 77 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari. (Jitendra Mohan Sharma, J) A.K.V./- U T
