====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 19-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Muffasil P.S. Case No. 705 of 2018, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act.

Counsel for the petitioner submits that there is no recovery of foreign liquor from possession of the petitioner. From the seizure list it appears that recovery has been made from Maruti Suzuki Alto car, Tata Indica and from Bush. Police apprehended Pawan Kumar. He disclosed the name of petitioner before the police.

Petitioner is in custody since 22.11.2018 having clean antecedent.

Patna High Court Cr.Misc. No.9895 of 2019(2) dt.19-02-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IInd-cum-Special Judge, Excise Act, Begusarai, in connection with Muffasil P.S. Case No. 705 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
