Although petitioner carries criminal antecedent but in the present case, petitioner was neither caught on the spot nor anything was recovered from his conscious possession. It appears that the name of petitioner came in confessional statement of co-accused and except the aforesaid confessional statement, there appears to be nothing against him in the present case.
