The petitioner seeks bail in connection with S.T. No. 334 of 2019 arising out of Saharsa Rail P.S. Case No. 25 of 2019 corresponding to G.R. No. 176 of 2019 for the offence under Sections 395 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 74568 of 2019, which is evident from Annexure-3, and the case of this petitioner stands on similar footing. The

Patna High Court CR. MISC. No.10921 of 2020(4) dt.02-07-2020 2/2 petitioner is rotting in judicial custody since 04.11.2019. Hence, the petitioner may be enlarged on regular bail. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Court of Fast Track Court- II, Khagaria in connection with S.T. No. 334 of 2019 arising out of Saharsa Rail P.S. Case No. 25 of 2019/ G.R. No. 176 of 2019.
