2. The petitioner apprehends arrest in connection with Kochas PS Case No.134 of 2021 dated 13.08.2021, instituted under Sections 406 and 409 of the Indian Penal Code.

3. The allegation against the petitioner is that he being the Secretary of the Implementation Committee of the Ward No. 05 of Kuchhila Gram Panchayat, withdrew Rs.15,70,485/- for Nal Jal Yojana and Nali Gali Scheme, but the work was not completed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the petitioner is the Secretary of the Implementation Committee of the Ward No.05 of Kuchhila Gram Pranchayat and the work for which the amount was

In this regard, a certificate has been issued by the Panchayat Office, which has been annexed as Annexure-3, however, the work has been completed after lodging of the FIR. It is further submitted that co-accused Raj Narain Singh, who is the President of the Implementation Committee has been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 16.02.2023 passed in Cr. Misc. No.62628 of 2022. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Sasaram, Rohtas, in Kochas PS Case No.134 of 2021, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

7. The application stands allowed.
