JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the First Information Report and it appears that the statement of victim has not been recorded as yet, because she could not be traced out.
The submission on behalf of the petitioners is that the victim being major, solemnized her marriage with co-accused Chitranjan Yadav and is residing with aforesaid co-accused Chitranjan Yadav. It has further contended by him that so far as the petitioners are concerned, they are languishing in jail custody since long and investigation against petitioner Nos. 1 and 2 have already been completed whereas, investigation against petitioner
Patna High Court Cr.Misc. No.56713 of 2015 (2) dt.15-12-2015 2/2 No. 3 has been kept pending.
Learned counsel for the petitioners, to fortify his contention, produced Photostat copy of affidavit said to be sworn by co-accused Chiranjan Kumar and victim. Let aforesaid Photostat copy of affidavit be kept on record. Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No. 68 of 2015.
