JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Gardanibagh P.S. Case No. 104/2016, registered for offences punishable under Sections 417, 420, 495, 496 and 34 of the Indian Penal Code.

It appears from the prosecution case that petitioner has compromized the matter with his wife on payment of Rs. 6,25,000/- and out of which, he has already paid Rs. 3,00,000/- and rest of the amount he has not paid and, thereafter, his bail bonds was cancelled.

It has been submitted on behalf of the petitioner that he is ready to return the amount and he has been in judicial custody since 20.09.2019.

Heard learned A.P.P. and learned counsel for the informant. They have opposed the prayer for bail

No.8477 of 2020(2) dt.27-02-2020 2/2 Having heard both sides, considering the nature of allegation, let the petitioner be enlarged on provisional bail for a period of two months to the satisfaction of concerned court below and within the aforesaid period, the petitioner is directed to pay the remaining amount to his wife and if he fails to pay the remaining amount, provisional bail granted to the petitioner shall stand automatically cancelled. It is also made clear that once the amount is deposited and petitioners filed a petition with receipt showing the payment, the court below after verifying the same shall confirm the bail bonds of the petitioner. This application stand disposed of.
