The petitioner seeks bail in Kashichak P.S. Case No.30 of 2014 instituted for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been alleged in the First Information Report that in the mid night the informant had heard sound of gun shot, rushed to the place where his son was sleeping and found that three persons were fleeing away from the place of occurrence. When he reached there he found that his son has died on account of gun shot injury. Other witnesses have stated about fleeing away of three persons.

Patna High Court Cr.Misc. No.56671 of 2015 (3) dt.09-02-2016 Learned counsel for the petitioner has pointed out that in the First Information Report there is no statement for carrying fire arms by the petitioner but later on it has been said that all the three persons were carrying rifle. Petitioner is in custody since 2.10.2015.

Looking to the period of custody, this Court is not inclined to enlarge the petitioner on bail at this stage. Accordingly the prayer for bail is rejected.
