Petitioner is said to have been caught by the police and the informant on the place of occurrence just after the occurrence but no arm was recovered from conscious possession of the petitioner. Submission on behalf of the petitioner is that there was altercation between the petitioner and the informant but informant lodged this false case against the petitioner and others in collusion with police. It is further pointed out by him that the petitioner do not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Chapra Town P.S. Case no. 372/2015. shahid (Hemant Kumar Srivastava,J) U T
